Guest and platform terms
Effective October 27, 2026 · Version 1.0 (2026-10-27.1)
These Terms govern the JaxBNB marketplace operated by JaxBNB LLC (JaxBNB, we or us). A Guest is a person booking or using a stay; a Host is the person or business identified as providing it. You accept these Terms through the affirmative acceptance presented when you create an account, publish a listing or book. A person accepting for a business must have authority to bind it.
These terms apply when affirmatively accepted on or after the effective date. Publishing an update alone does not amend a previously accepted agreement or an existing booking. You may save or print this page for your records.
1. Know who provides your stay
JaxBNB connects Guests with Hosts. For an independently operated listing, the stay contract is between the Guest and the Host identified before booking. The Host provides the accommodation, access, cleaning, maintenance and on-site response unless the listing expressly assigns a service to someone else. Listing a property does not itself make JaxBNB its manager.
Some properties are managed or operated by JaxBNB. The listing and confirmation must identify that role and the lodging provider. When JaxBNB acts as an owner’s disclosed agent, the owner remains the lodging provider; JaxBNB remains responsible for its own services and duties imposed by law. A marketplace disclaimer does not erase responsibilities JaxBNB actually undertakes.
The booking details, price, cancellation policy, house rules and any required rental agreement must be available before payment and form part of the stay contract. The JaxBNB Reviews and Content Policy also applies. Hosts separately accept the Marketplace Host Terms. A host agreement cannot reduce a Guest’s rights under these Terms. Mandatory law controls any conflict; a booking-specific term controls its disclosed price, dates and house rules, subject to the protections here.
2. Accounts and permitted use
You must be at least 18 and legally able to contract. Supply accurate identity, contact and payment information; secure your login; and promptly report suspected unauthorized use. A higher minimum age for a particular stay must be lawful and clearly disclosed before booking. Do not impersonate others, submit fraudulent bookings, evade lawful restrictions, discriminate unlawfully, threaten people, misuse personal data, or interfere with the platform or its security.
Do not scrape restricted data, bypass access controls, send spam, or reproduce protected platform material without permission or a legal right. Do not move a pending JaxBNB booking or its payment off-platform to evade an agreed fee. This does not restrict lawful complaints, honest reviews, ordinary emergency communications or independently sourced business.
We may request information reasonably needed to verify identity, authority, compliance or payment. A verification label describes only the check expressly stated; it is not a guarantee of safety, identity, property condition or future conduct. Any background screening requiring separate disclosures or permission will use that separate process.
3. Booking and payment
A booking is confirmed only when the designated Host or authorized booking system issues a confirmation. A request or payment authorization alone is not a confirmation. Review the property, dates, occupancy, restrictions and accessibility information before accepting. Ask about a material need before booking; Hosts must answer accurately and comply with applicable accommodation laws.
Before you commit, checkout must identify the lodging provider, the payment collector, the cancellation terms, the full amount payable and any installment schedule or refundable security deposit. Advertised prices include mandatory lodging-related charges, including mandatory cleaning and service fees. Government taxes may be separately displayed where lawful, but the final amount including taxes and selected extras must appear before payment. Optional extras require an affirmative choice.
You authorize the booking charges and payment dates disclosed and accepted at checkout. Deposits, authorization holds and later charges require the applicable disclosed terms and lawful payment authorization. These Terms alone do not authorize unrestricted future debits. Payment services may involve a third-party processor under its separately presented terms. We do not describe booking funds as insured deposits or escrow unless a separate lawful arrangement expressly provides that protection.
A successful payment through the collection method the Host designated for the booking satisfies that amount of the Guest’s payment obligation, subject to a lawful reversal. A Host may not collect it again because a payout is delayed. A suspected payment error should be reported promptly. Nothing here limits cardholder, bank-dispute, chargeback or other nonwaivable payment rights; knowingly false claims and double recovery are prohibited.
4. Changes, cancellations and stay problems
For a Guest’s voluntary cancellation, the policy accepted at booking controls the refund, including its deadlines, time zone and treatment of each fee. A change requires the agreement shown in the booking system or a written confirmation from the authorized provider. Later policy changes do not retroactively reduce an existing booking’s rights.
If the Host cancels, double-books, cannot provide lawful access, or cannot provide a substantially usable accommodation as described, the Guest is entitled to a refund for the affected, unused portion and associated mandatory charges and taxes, with a full refund if the stay cannot reasonably begin. This minimum protection prevails over a conflicting host cancellation policy; greater legal rights remain. The responsible provider funds its share, and JaxBNB refunds its own affected Guest service fee, if any.
Report a material problem to the Host and JaxBNB as soon as reasonably possible, with safe-to-obtain evidence, and allow a reasonable opportunity to address it when appropriate. Delay may affect what can be established or remedied, but creates no automatic waiver of legal rights. Immediate danger should be reported to emergency services first. We may help communicate, review records and administer an authorized refund; we do not promise substitute lodging, reimbursement beyond applicable obligations, or a particular dispute outcome.
Ordinary weather, changed plans, travel delays or a concern outside the property do not by themselves guarantee a refund. Government restrictions, mandatory evacuations, unavailable or unsafe accommodation, and other events are assessed under the booking terms and applicable law. No force-majeure provision excuses a refund legally due or payment for services not provided when a refund is required here.
5. Guest responsibilities and damage claims
Use the accommodation lawfully, respect neighbors, comply with disclosed occupancy and house rules, and leave at the agreed checkout time. Do not host unauthorized parties, tamper with safety equipment or bring unapproved occupants. Rules about pets do not override legally required assistance-animal accommodations. You are responsible for the conduct of people you invite or authorize to use the property, to the extent permitted by law.
You are responsible for proven physical damage or extraordinary cleaning caused by you or those people, excluding normal wear, pre-existing damage, ordinary turnover cleaning and losses you did not cause. A claim must reasonably identify the cause and amount, with photos, records and reasonable repair costs or replacement value accounting for age and condition. No automatic penalty or new-for-old windfall applies.
A Host seeking platform assistance should report a claim within 14 days after checkout, or promptly after reasonably discovering concealed damage, and preserve relevant evidence. We will provide the Guest the claim and a reasonable opportunity to respond before a non-emergency platform decision. A disputed claim is not automatically a debit authorization. Payment requires the Guest’s separate agreement or another legally valid basis and any required payment authorization. Administrative review does not finally determine legal liability or prevent either party from pursuing lawful remedies.
The stay grants only the occupancy rights permitted by the actual arrangement and applicable law. Calling a booking “short term” does not waive tenancy, deposit, notice, access or eviction laws. Hosts and JaxBNB must use lawful procedures; these Terms do not authorize an unlawful lockout, seizure of property or entry.
6. Content, reviews and privacy
You retain ownership of content you submit. You grant JaxBNB a nonexclusive, royalty-free license to store, display, reproduce, format and transmit it as reasonably needed to operate the marketplace and show the relevant listing or review. Service providers may use it only for those purposes. You must have the rights needed to provide the content. We do not take ownership of consumer reviews or acquire a right to use someone’s likeness as a separate advertising endorsement without appropriate permission.
The Reviews and Content Policy explains prohibited content, removal grounds, reporting and appeals. Honest negative feedback is allowed. A refund, payout, warranty, dispute settlement or other benefit may not be conditioned on suppressing a protected honest review. Reviews express their authors’ experiences; publication is not our verification of every statement.
Our Privacy Notice explains how JaxBNB handles personal information and privacy choices. Do not post access codes, financial details or private identifying information. Hosts may use Guest information only for the booking, lawful compliance and separately authorized purposes; it is not a marketing list. Marketing texts, marketing emails, recording and sensitive-data uses require the permissions and disclosures applicable to them, rather than blanket consent through these Terms.
JaxBNB may retain records needed for an existing booking, security, a dispute or a legal obligation, consistent with the Privacy Notice and law. Withdrawal of public content does not require deletion of records that must lawfully be preserved.
7. Enforcement and service availability
We may decline or restrict a listing, remove prohibited content, suspend an account or end access for a material breach, credible fraud or safety risk, unlawful activity, payment default, or a legal or processor requirement. Action will be proportionate to the issue where reasonably possible. We may act immediately when delay risks harm or violates law; otherwise we ordinarily give notice and a reasonable opportunity to correct a remediable problem.
We will explain the material reason and an appeal route unless legally restricted or disclosure would compromise safety or fraud prevention. Email info@jaxbnb.com with the decision and supporting information to request review. A complaint or honest negative review alone is not grounds for retaliation. Removing an account does not erase earned refunds, valid payment duties or the need to address existing reservations.
The platform may be interrupted, changed or discontinued. We will use reasonable efforts to communicate a material interruption affecting confirmed bookings. We do not guarantee uninterrupted availability, any search position, occupancy, revenue, a damage recovery or an independent Host’s performance. Platform access is provided as available, subject to express promises here and rights that cannot lawfully be excluded.
8. Limits on platform liability
Please read this section. It allocates economic risks of using the marketplace.
To the extent permitted by law, JaxBNB is not responsible merely because it lists a property or assists with a booking for independent parties’ acts, guest damage, normal wear, outages, weather or other events it did not cause and is not legally required to prevent or remedy. This does not excuse JaxBNB’s own breach, negligence or obligations for a property it actually manages or operates.
For claims arising from marketplace services, and subject to the exceptions below, JaxBNB’s total liability to a Guest for direct economic loss is limited to the greater of $1,000 or the total booking amounts that Guest paid through JaxBNB in the 12 months before the event. For a Host, the limit is the greater of $1,000 or marketplace commissions that Host paid JaxBNB in that period. For another user, it is $1,000. Related events share one applicable cap. These limits apply to contract, tort and ordinary-negligence claims for platform economic loss.
Subject to the same exceptions, neither JaxBNB nor a user owes the other consequential, special or punitive damages, including speculative lost profits, arising from marketplace services. This does not exclude direct repair costs, an expressly promised refund or other direct losses within the applicable cap. The protections for JaxBNB also apply to its personnel acting within their roles, with a shared limit rather than a separate limit for each person.
None of these exclusions or caps limits fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, legally protected consumer or privacy remedies that cannot be limited, or any other nonwaivable liability. They do not reduce duties to account for and remit money, pay an earned payout, provide an owed refund, or perform an express service obligation. Claims arising from JaxBNB’s actual lodging or property-management services are not subjected to these marketplace caps merely because the property appears here. A separate agreement may govern those services, subject to law.
9. Third-party claims
A user is responsible for third-party claims to the extent caused by that user’s fraud, intentional unlawful conduct, or infringement through content the user supplied. Hosts have additional, specifically limited obligations under the Marketplace Host Terms. No user must reimburse JaxBNB for the portion of a claim caused by JaxBNB’s negligence, breach or misconduct. This provision does not turn an honest review, a good-faith refund request or a direct contract dispute into an indemnity claim.
A party requesting indemnity must promptly give notice, cooperate and mitigate loss. Defense costs must be reasonable and relate to the covered third-party claim. Counsel must be reasonably acceptable to the protected party and insurer. A settlement imposing an admission, payment or other duty on a protected party requires its written consent, not unreasonably withheld. No duplicate recovery is allowed.
10. Resolving a dispute with JaxBNB
Before an ordinary court action, send a written notice describing the dispute, requested result and booking or account details. Send it to info@jaxbnb.com; JaxBNB may send its notice to your recorded email. The parties will try in good faith to resolve the matter for 30 days after receipt. Mediation and its charges require mutual agreement.
This process is not a barrier to small-claims court, emergency relief, a filing needed to preserve a deadline, a payment dispute or a complaint to a regulator. It does not shorten statutory deadlines. We do not require private arbitration, and these Terms do not impose a class-action or jury-trial waiver.
Florida law governs to the extent permitted by law, without taking away mandatory protections of the law otherwise applicable to a consumer. Subject to those protections and any mandatory forum, disputes with JaxBNB belong in the state courts in Duval County, Florida, or, when federal jurisdiction exists, the United States District Court for the Middle District of Florida, Jacksonville Division. Either party may use an otherwise competent small-claims court where law requires or permits that option despite a contractual venue restriction.
Each side pays its own attorneys in direct disputes under these Terms, except for an award authorized by applicable statute, court rule or sanction. Legally recoverable court costs remain available. The limited obligations for covered third-party claims are separate. These Terms do not guarantee that either party can avoid litigation or defense expense.
11. Changes, ending use and other terms
We will give 30 days’ notice of material changes, except earlier changes reasonably required by law or immediate security needs. Changes apply prospectively with legally required acceptance. Confirmed bookings keep their accepted commercial terms. Host commission changes require a separately accepted fee agreement; continued use alone does not change the rate.
You may stop using the marketplace and request account closure. Existing payment, refund, record-preservation and dispute obligations continue as necessary. Invalid provisions are severed only as necessary; the lawful remainder survives. Failure to enforce once is not a continuing waiver.
These Terms and incorporated documents govern marketplace use. Separate management, co-hosting, cleaning and setup agreements govern their stated services. A specific agreement signed by JaxBNB may modify its parties’ rights without reducing others’ rights. A business successor may assume this agreement without reducing existing consumer rights. Legal process requires lawful service.
Booking technology and payment providers may separately present their own agreements. LocalOTA LLC supplies the reservation technology at book.jaxbnb.com; its separately accepted terms govern its services. These JaxBNB Terms govern JaxBNB’s marketplace services and do not amend an agreement with another provider. Any conflict affecting the price, cancellation terms or payment authorization must be resolved and disclosed before a booking is accepted; mandatory law and nonwaivable Guest rights remain controlling.
