Independent listings, fees and payment responsibilities
Effective October 27, 2026 · Version 1.0 (2026-10-27.1)
These Host Terms supplement the JaxBNB Marketplace Terms of Service. They apply when you offer accommodation through the marketplace and must be affirmatively accepted with the completed fee and payment schedule before your listing becomes bookable. They do not purchase property management, co-hosting, cleaning or setup services; those require a separate agreement.
1. Your authority and property obligations
You confirm that you own the property or have documented authority to list it, accept bookings and bind the lodging provider. Identify the legal lodging provider and the person responsible for local service. Keep ownership, contact, payout, tax and licensing information current. You are responsible for the accuracy of information supplied by your co-hosts, managers and channel software on your behalf.
Before accepting bookings, obtain and maintain the permissions, licenses, registrations, insurance and tax accounts applicable to the property and your activities. Verify the actual municipality and zoning, state lodging requirements, building and fire safety, occupancy, association restrictions, lease and mortgage restrictions, parking, accessibility obligations and any lawful minimum stay. A Jacksonville mailing address is not proof that Jacksonville rules apply; separate beach municipalities may have different requirements.
Give JaxBNB evidence reasonably needed to verify eligibility and promptly disclose a restriction, lapse, serious hazard, citation or investigation affecting a stay. We may pause new bookings while a material issue is unresolved. Our review does not transfer your legal duties to us or substitute for an inspection by a qualified professional.
2. Accurate listings and reliable operations
Describe the actual property, condition, amenities, fees, limitations and accessibility accurately. Disclose material construction, shared spaces, stairs, pools and other significant hazards or limitations before booking. Keep calendars and prices synchronized and honor confirmed reservations. Do not substitute a different property without the Guest’s informed agreement or charge an undisclosed mandatory fee.
Provide lawful access, clean and safe accommodation, functioning required safety equipment and a reachable local emergency contact. Respond reasonably promptly to material problems. You arrange and pay for cleaning, maintenance, supplies, repairs and guest service except for services JaxBNB separately agrees to perform. Marketplace listing or an optional cleaning purchase does not create a general management engagement.
Interior cameras and interior audio or video recording devices are prohibited. Lawful exterior cameras and noise monitors that do not record conversations must be disclosed before booking, with their locations and operation accurately described. No device may view a private area. Do not record audio or collect biometric or sensitive data without all legally required authority, disclosures and consent. Respect assistance-animal, nondiscrimination and accessibility duties.
Maintain property and liability insurance expressly permitting the actual short-term rental use, with limits appropriate to the property and operations. Provide evidence on reasonable request. Platform participation is not insurance, a property inspection or a guarantee against damage, fraud, chargebacks, vacancies or loss of income.
3. Marketplace commission and payment schedule
Unless a different fee schedule is expressly agreed for your listing, JaxBNB marketplace commission is 10% of the LocalOTA commission base: all booking amounts and all mandatory or optional charges, fees, extras, add-ons, packages, services, surcharges and other amounts paid or payable by the Guest, excluding only Actual Taxes. This includes cleaning fees and other guest fees; it is not limited to nightly revenue plus cleaning. The commission is calculated before payment-processing fees. “Actual Taxes” means legally imposed government taxes separately identified to the Guest, collected solely for remittance or as required by law, not retained as Host revenue, and supported by reasonable tax records. A fee or pass-through operating cost is not a tax merely because it is labeled one. Commission may remain due on a completed stay, chargeable no-show, late cancellation or nonrefundable booking, as provided by the accepted LocalOTA account terms. Previously accepted different rate or base terms remain effective for bookings governed by those terms unless lawfully changed by affirmative agreement.
You pay actual processing charges attributable to your bookings under the disclosed processor pricing, including applicable nonrefunded processing or dispute charges. JaxBNB adds no markup unless a separate written fee agreement states it. The same marketplace service is not charged twice. A management agreement or signed fee schedule must expressly state whether marketplace commission is included or separately payable; management and marketplace charges are not automatically stacked. No management onboarding fee, reserve or $2,000 setup charge is created by these Host Terms. A setup-only service requires its own separately purchased agreement.
Your accepted fee and payment schedule
Before a listing becomes bookable, the account offer or signed schedule must identify the Host’s legal name and authority; covered properties; commission rate and exact base; lodging seller; payment collector; actual merchant of record; processor and applicable processing and dispute charges; payout trigger and timing; any authorized deductions or reserve and its release terms; and any separate debit authorization. An omitted reserve is not an authorization for a discretionary JaxBNB reserve. The record must include the schedule version, effective date and the Host’s affirmative acceptance.
For the standard direct-payment connection advertised on book.jaxbnb.com, the Host remains the merchant for the lodging transaction and receives Guest payments through the Host’s connected payment gateway or property-management software. That processor or software controls the actual payout schedule. The booking provider currently describes marketplace commission billing on the first of the month after completed stays, subject to the accepted account arrangement and a valid payment authorization. Do not substitute the separate managed-property owner payout schedule for this marketplace arrangement. A different collection or settlement arrangement requires its own clear schedule and acceptance.
LocalOTA’s service-provider agreement and your processor or property-management-software agreements govern those providers’ services. Review their fee disclosures before accepting them. JaxBNB cannot amend a contract with another provider through this page. A separate written offer accepted by JaxBNB and the Host may provide a different rate or scope; keep that offer with your account records.
4. Collection, refunds and accounting
To the extent the completed schedule appoints JaxBNB to collect booking payments, you authorize it to act as your limited collection agent for those payments and to administer refunds required by the accepted booking terms, marketplace policies or law. A Guest’s successful payment to the designated collector satisfies that amount owed to you, subject to a lawful reversal. You must not demand a second payment because the collector or processor has not yet paid you.
You authorize deductions from your booking proceeds for earned commission, disclosed actual processor charges, taxes the collector must remit, Guest refunds properly chargeable to you and documented adjustments under these Host Terms. A transfer to your bank is not a guarantee that a card payment cannot later be reversed. Payment and tax obligations imposed by law or the processor remain with the party legally responsible; naming you the lodging seller does not override those obligations.
5. Refunds, payment holds and disputed amounts
Guest refunds are governed by the booked cancellation policy, the Guest protections in the Marketplace Terms of Service and applicable law. You must fund refunds properly owed for your lodging services and return overpaid proceeds. Commission adjustments, credits and nonrefunded processing or dispute charges follow the accepted LocalOTA account terms and the applicable processor arrangement; a Guest refund does not by itself establish that the provider refunds every commission or processing charge. JaxBNB will not collect the same commission twice and will pass through or apply a commission credit it receives for your booking to the extent it belongs to you. We do not create a separate automatic refund formula that conflicts with your accepted provider arrangement.
JaxBNB does not receive or hold your lodging proceeds under the standard direct-payment arrangement and these Host Terms create no discretionary JaxBNB reserve. A processor may impose holds under its own accepted agreement or law. If a separately accepted collection arrangement authorizes JaxBNB to hold funds, any hold must be limited to the documented amount reasonably related to an identified refund, chargeback, fraud concern or legal or processor requirement, within that agreed authority. We will identify the basis and amount when legally permitted, review a JaxBNB-controlled hold at least every 30 days, and release funds no longer reasonably needed. Undisputed funds remain payable on the agreed schedule.
We will provide an itemized statement of amounts due and allow a reasonable opportunity to challenge an adjustment, consistent with any external response deadline. You must promptly provide accurate booking and service records needed to address a payment dispute. Chargebacks and their reasonable documented charges are allocated to you to the extent arising from your lodging transaction or breach, excluding loss caused by JaxBNB’s own payment error, negligence, breach or misconduct. Neither party may recover the same amount twice.
A valid negative balance is payable within 15 days after an itemized notice, subject to a good-faith dispute and any mandatory rules. Any separate bank or card debit must comply with its own lawful authorization and notice requirements. These Host Terms do not themselves grant an unlimited bank-debit mandate. We do not promise to fund payouts before collection, absorb your chargebacks or reimburse every unsuccessful damage claim.
6. Taxes, data and channel permissions
The completed payment arrangement and booking record must identify taxes the platform or collector collects and remits. You remain responsible for taxes, filings and records legally assigned to you, including amounts not collected on your behalf. JaxBNB remains responsible for duties legally assigned to it. Cooperate with lawful reporting and withholding, and do not represent a tax as remitted merely because a Guest was charged it.
Use Guest information only for the booking, safety, lawful recordkeeping and separately authorized purposes. Apply reasonable security, limit access, and promptly notify JaxBNB of an incident affecting shared Guest data. Do not sell that data or add Guests to marketing campaigns without the necessary legal basis and permission. Each party remains accountable for its actual data practices.
You authorize display and distribution of listing material you have the right to supply through the channels specifically enabled for the property. Keep permissions from photographers and other rights holders. Do not import reviews, scrape another platform, reuse a platform’s brand or export Guest data unless you have the required rights and comply with the relevant channel agreement. External-channel bookings remain subject to that channel’s applicable terms; these Host Terms do not override them.
7. Guest damage and claims involving others
Normal wear, aging, ordinary cleaning, defects, Guest damage and independent vendor failures are property risks allocated to you except to the extent caused by JaxBNB’s breach or negligence or covered by an express separate service promise. Use the documented damage process in the Terms of Service. You may not assess unsupported penalties, require a Guest to waive review rights, or treat platform assistance as insurance or guaranteed collection.
To the extent permitted by law, you will defend, indemnify and hold harmless JaxBNB and its personnel from third-party claims arising from your property, lodging services, inaccurate listing or compliance information, infringement in supplied content, unlawful use of Guest data, or your breach of these Host Terms, but only to the extent attributable to you or persons for whom you are legally responsible. This includes reasonable covered defense costs and legally payable settlements or judgments, without duplicate recovery.
You do not indemnify any protected party for the portion caused by that party’s negligence, breach, fraud or other misconduct. The notice, cooperation, counsel and settlement safeguards in the Terms of Service apply. Claims by you against JaxBNB under the contract are direct disputes, not third-party indemnity claims. JaxBNB’s own management or lodging services remain subject to the agreement and law applicable to those services.
8. Ending a listing and changing fees
You may stop accepting new bookings and end marketplace participation on written notice. JaxBNB may do the same with 30 days’ notice, or act sooner under the safety, breach, fraud, nonpayment or legal grounds in the Terms of Service. There is no fixed marketplace commitment or termination fee under these Host Terms.
Existing confirmed bookings must be honored or lawfully resolved, including refunds and any properly established direct losses caused by a breach. Stop dates do not erase earned commission, pending refunds, lawful reserves or reporting duties. We will provide reasonable access to your booking and settlement records needed to close out the relationship, subject to privacy, security and legal restrictions. No reserve is retained solely because you leave.
Commission-rate or Commission Base changes require a new, affirmatively accepted fee agreement. They apply only to bookings made after the agreed effective date unless the parties expressly and lawfully agree otherwise. JaxBNB may decline new business if no new agreement is reached; accepted existing bookings keep their original commercial terms. Material payment or reserve changes likewise require the agreement or notice required by the governing arrangement and law.
9. Relationship to other agreements
The Marketplace Terms of Service govern liability for marketplace services, dispute notice, venue and general terms. These Host Terms govern the particular Host obligations described here. A separate management, co-hosting, cleaning or setup agreement does not apply to a marketplace-only listing merely because the same company provides those services elsewhere.
If JaxBNB also manages your property, identify the applicable management agreement and how commissions interact in a signed schedule before publishing. These Host Terms do not amend an existing signed management agreement or enlarge services without that agreement’s required consent. Neither party is released from a statutory, licensing, trust-account, tax or payment obligation by the label used in this agreement.
